(中央社記者余曉涵台北14日電)勞動部廢除民國75年發布的函釋，從8月1日起，勞工必須每7天就要休息1天。客運業者今天表示，會儘快跟交通主管機關協調，如果實務上無法配合，只能減班或停駛因應。

勞動部日前廢除在民國75年發布的函釋「台內勞字第展覽出清價398001號函釋」，讓勞工從8月1日起必須每7天就要休息1天。12名客運業者公會代表今天赴勞動部跟勞動部長郭芳煜陳情，希望將運輸業者納入4周變形工時的範圍內。

不過，現階段勞動部希望客運業者以增加人力的方式因應，並且強調依法運輸業者無法納入4周變形工時(勞基法第30條之1)的範圍內。

國光客運總經理吳忠錫則說，如果問題無法解決的話，8月1日就會面臨相關問題，業者會儘快跟交通主管機關協調。

他說，最快8月1日起，客運業者就會以減班或停駛的方式，讓司機符合勞基法的規範。

吳忠錫強調，平常一定讓司機維持在每7天休1天的勞動條件，但遇到連續假期等尖峰時刻，如果沒有彈性，業者就無法排班。

他以今年中秋節是從星期四開始的連續假期舉例，如果中秋節要加開班次，為了符合勞基法，司機在星期二或星期三會提前休假，那星期二跟三的人力就會不足，就有可能用減班因應。1050714
